Please join Ron Laurie, Peter Kang and Dana Hayter in a discussion of the U.S. Supreme Court’s decision in Impression Products v. Lexmark International.

Discussion to include:

  • The impact of Impression Products on the U.S. law of patent exhaustion and related overseas activities.
  • Some questions the Impression Products decision leaves open for patent practitioners, litigators and technology transaction professionals.
  • Transactional and structural options to address the impact of patent exhaustion (or the risks posed by the questions the Impressions case leaves open) in various types of transactions and other activities, along with potential benefits, disadvantages and risks posed by those options.

SPEAKERS:
Dana Hayter, Perkins Coie LLP
Dana is a Partner in the Technology Transactions Group of Perkins Coie LLP. His practice focuses on patent and technology licensing, acquisitions and sales, along with related company legal and business strategy. Dana joined Perkins Coie in 2015, with more than 20 years of experience practicing intellectual property in the technology sector. Prior to joining Perkins Coie, Dana was Intel's Vice President of Technology Licensing and an Associate General Counsel for the company.

Peter Kang, Sidley Austin LLP
Peter is a senior IP trial attorney and #1 ranked author. His experience includes over a dozen trials (both in district courts and before the ITC), multiple Federal Circuit arguments, and First Chair counsel in seven trials, including a patent defense jury verdict resulting in a $4.6 million fee award for his client. He has argued over a dozen times before the Patent Trial & Appeal Board, including victory in the first IPR to reach final judgment. Peter negotiates IP licenses worldwide and advises on IP diligence issues in corporate transactions. He is an AAA arbitrator and Immediate Past President of the International Association of Korean Lawyers. Peter is a founding Partner of Sidley Austin LLP’s Palo Alto office.

Ron Laurie, Moderator, Inflexion Point Strategy
Ron is Managing Director at Inflexion Point Strategy, LLC, the first IP investment bank, which he founded in 2004. As a lawyer, Ron was a founding partner of Skadden Arps’ Silicon Valley office, where he chaired the firm’s IP Strategy and Transactions practice group for six years and led IP diligence teams in some of the largest high-tech and life sciences M&A, joint venture and technology spin-out deals ever done, worth over $50 billion in aggregate. He was also a founding partner of the Silicon Valley offices of Weil, Gotshal and Irell & Manella. Ron is the LES Silicon Valley Chapter Vice-Chair.
