PROGRAM:
Please join us for a panel discussion on managing outside counsel from the perspective of two in-house counsel with extensive experience in both in-house and outside counsel positions.

Discussion to include:

  • Advantages/disadvantages of retaining multiple outside counsel
  • Use of fixed fee schedules and/or standardized retention agreements across multiple outside counsel
  • Oversight of outside counsel work product
  • Communication with outside counsel
  • Billing frameworks; how budgeting happens in-house
  • Developing outside counsel guidelines that are workable for both in-house and outside counsel

SPEAKERS:
Kelvin Vivian is the Director of Intellectual Property at Marvell Semiconductor where he manages Marvell’s IP team in worldwide portfolio development, operations, and strategic initiatives. Kelvin received his B.S. degree in Electrical Engineering and Computer Science from UC Berkeley, and obtained his J.D. from the George Washington University Law School during which he had an opportunity to intern for former Judge Randall Rader at the United States Court of Appeals for the Federal Circuit. Prior to joining Marvell, Kelvin served as outside counsel and specialized in prosecuting patents for a number of technology companies including Marvell, Adobe Systems, Apple, Applied Materials, Atmel, IBM, Intel, Invensense, Lenovo, SAP, and Qualcomm, among others. On weekends, and some weekday nights, Kelvin can be found running fields in a game of soccer.

Stephen Shaw is the Lead Patent Attorney at Fitbit, where he manages all aspects of the Fitbit patent program as well as supervising IP licensing issues, coordinating the Open Source program, and providing IP litigation support. Stephen has also been in-house counsel for Adobe, Qualcomm, and Gracenote. Stephen worked as a Senior Associate at Hogan Lovells immediately prior to joining Fitbit. While in private practice at Hogan Lovells and other firms, Stephen prosecuted patents and developed IP strategies for companies such as Amazon, Apple, Lyft, Oracle, Cisco, Ricoh, Brocade, Yahoo, and others. Stephen has also been an IP litigator, representing both plaintiffs and defendants in numerous patent, trademark, copyright, and trade secret cases.

Moderator: Christian Scholz is a Partner at Weaver Austin Villeneuve & Sampson Intellectual Property Law (WAVS IP), where he handles the drafting and prosecution of patent applications for a variety of clients, including Fitbit, Qualcomm, Lam Research, and Bio-Rad Laboratories. Christian obtained a B.S. in Mechanical Engineering from the University of Oklahoma and an M.S. in Mechanical Engineering from University of Washington before working for Sandia National Laboratories in Livermore, CA, for seven years, where he worked on defense and counter-terrorism projects. Christian then obtained his J.D. at University of California Los Angeles and has been with WAVS IP in Oakland, CA, since 2009.
